Kenya’s Parliament has considered a Whistleblower Protection Bill four times: in 2017, 2019, 2021 and most recently through the Whistleblower Protection Bill, 2023 (Bill No. 56 of 2023). The issue remains a legislative priority, but there is still no dedicated whistleblower protection law in force.
The current Bill is expected to introduce a unified disclosure framework, criminalise reprisals against whistleblowers, require Commission on Administrative Justice-approved internal policies, and create a reward fund for eligible disclosures. These measures would support stronger, more trusted speak-up cultures in Kenyan organisations.
