Professional Trustee Services and Fiduciary Services for High-Net-Worth Families in Kenya
After decades of serving select private clients through ALN Kenya | Anjarwalla & Khanna, regularly ranking in Band 1 by Chambers High Net Worth, a leading global directory, we are delighted to announce the launch of Adili Fiduciary Services (AFS).
AFS is an independent and agile corporate trustee providing professional trustee services and fiduciary services to high-net-worth families. AFS will work hand in hand with ALN Kenya to fully understand the nature of the family assets and the family dynamics. All succession planning solutions are bespoke considering each family’s unique requirements and desired outcomes. All relevant legal issues are also considered from a taxation angle to ensure the solution suggested is tax efficient.
In this regard, AFS offers a range of advisory services, including tax, estate and trust administration and estate and succession planning solutions using effective structuring tools like family trusts, family companies and other legal arrangements which are robust, legally effective and tax efficient. AFS does not however provide any investment advice.
The uncertainties of life highlighted by the ongoing Covid-19 pandemic have brought to light the importance of effective estate and succession planning for a family’s assets and wealth, regardless of one’s stage in life.
“For many successful families the smooth and legal effective inter-generational transfer of wealth and assets is a critical decision to make if capital and wealth is to be preserved,” comments Director Atiq Anjarwalla. “AFS is set to play a key role in supporting the continuation of family businesses, succession planning and tax planning.” Atiq has been practicing for over 37 years in London and across several African markets. He has experience advising high net worth clients on their succession and family matters, including advising on complex family business ownership structures, offshore trusts, succession, family wealth protection planning, and setting up of trusts for charitable purposes.
The introduction of Adili Fiduciary Services heralds a significant shift when it comes to providing bespoke trustee services and fiduciary services to high-net-worth families in Kenya.
“It is in the interest of the preservation of family wealth to obtain high quality legal and tax advice on these sensitive yet critically important personal matters,” comments Co-Director Mona Doshi during the launch, “and thorough planning means accounting for all your local and international assets and having an open and frank discussion on the aims and aspirations of the family.” Mona, who is also a Partner at ALN Kenya and leads the firm’s Private Client department, looks after the affairs of high-net-worth clients, including drafting wills and trusts, advising on succession planning, handling probate work and managing various aspects of a client’s wealth protection plan.
According to AFS Senior Tax Advisor and Partner at ALN Kenya, careful planning means being able to account for one’s assets – local and international – and having an open and frank discussion on the aims and aspirations of the family. “The launch of Adili Fiduciary Services means that clients can be assured of a confidential, bespoke service from one of the industry’s most experienced and trustworthy legal and tax advisers.” Kenneth has specialist skills in Kenyan and cross border taxation and routinely assists the private client team on tax issues impacting estate and succession planning undertaken for high-net-worth clients. In addition, AFS will also provide executor services under wills through its affiliated firm Adili Executor Services (AES). AES can therefore act as an executor of a Will which allows professionals to handle the estate of a deceased person taking away the risks and complications for family members or others to handle estate affairs of a deceased person. As such AES will apply for probate, will collect estate assets, maintain estate accounts, distribute estate assets to the beneficiaries in a professional manner with the full backing of ALN Kenya.
